1. Terms and conditions

1.1 Overview (a) Welcome to cleverlittlepicnic.com (Website). This Website is owned, maintained and operated by Clever Little Picnic Co Pty Limited ABN 34 660 732 703 (Clever Little Picnic, we, us or our). (b) We want our customers (you, your) to have a secure and enjoyable shopping experience when visiting our Website and online store contained within (Online Store). These terms and conditions, together with our policies (available online on our Website) will govern the use of this Website and our Online Store. (c) By using the Website, you acknowledge and agree with these terms and conditions. Clever Little Picnic reserves the right to review and amend these terms and conditions at any time. The usage of the Site after any modifications of these terms and conditions will mean that you agree with all changes. (d) Where the provisions of any consumer protection law, or any mandatory legislation that cannot legally be excluded applies, these terms will be read subject to the application of that legislation, and in the case of any conflict, the provisions of that legislation will apply.

1.2 Limitation of liability
To the full extent permitted by law, Clever Little Picnic, its directors, employees, agents, contractors and related bodies corporate, will not be liable to any person in respect of any loss or damage (including any indirect, economic, special or consequential loss or damage (including but not limited to any loss of actual or anticipated profits, revenue, savings, production, opportunity, goodwill or use) or any remote, abnormal or unforeseeable loss) which may be suffered or incurred or which may arise directly or indirectly from or in connection with:
(a) any use of this Website including the Online Store or any advice or Information received on this Website including through the Online Store;
(b) any transaction entered into through this Website or Online Store; or
(c) the performance of this Website or Online Store, whether or not the loss or damage was as a result of error or misrepresentation, negligent act or omission, or any other cause whatsoever.

1.3 Warranties
(a) Clever Little Picnic gives no warranties as to the accuracy, currency, suitability or completeness of any information contained on or accessed through this Website or Online Store (Information). Information provided on the Website or Online Store is subject to change at any time without notice and may not necessarily be up to date at the time you view the Information.
(b) Clever Little Picnic may, without notice to you, and at any time, modify or discontinue any services offered on this Website or Online Store.
(c) Clever Little Picnic takes no responsibility for, and will not be liable for, any programming bugs, viruses, faults, or errors or anything else which may damage a device used to access this Website. It is your responsibility to ensure you scan for any viruses or faults before accessing our Website or Online Store.
(d) By using this Website and Online Store you acknowledge and agree that:
(i) we do not warrant that any message or transaction you post, upload or otherwise transmit to or form this Website or Online Store will be received by the intended recipient; and
(ii) we do not warrant or represent that access to this Website or Online Store will be uninterrupted.

1.4 Delivery, title and risk
(a) We will use all reasonable endeavours to supply the products purchased on our Online Store (Order) to the delivery address specified by you in the Order (where relevant) and meet your requested delivery dates. We do not guarantee delivery on that date.
(b) If we are unable to supply the Order, including without limitation as a result of events of force majeure or otherwise, we will promptly notify you in writing of the anticipated extent and duration of our inability to supply.
(c) In no circumstances will we be liable or otherwise responsible to you for any claim, cost, damage, debt, expense, tax, loss, liability, tax, allegation, suit, action, demand, cause of action, proceeding or judgment you incur if we fail to deliver or are prevented from delivering the Order to you by any estimated or confirmed delivery date.
(d) Although we do our best to ensure prices stated on the Website are accurate, errors do occur from time to time. Where a pricing error occurs (subject to applicable law that cannot be excluded), we will not be bound by the incorrect pricing stated, and reserve the right to cancel your Order.
(e) Clever Little Picnic retains title in the products in purchased until it receives payment in full in respect of an Order (and, in respect of a purchase of alcohol where we meet you at a designated site or where you collect the alcohol from us at a designated site, you have provided us with appropriate identification as set out in clause 6).
(f) Risk in and responsibility for the products passes to you at the time of delivery to the premises specified in the Order.

2. Rescheduling and cancellation policy
2.1 Need to change the date of your picnic? Not a problem, all we ask for is you to email us at cleverlittlepicnic@gmail.com with 48 hours notice in advance.
2.2 Once an Order has been processed, it cannot be cancelled without our consent.
2.3 We have the right to refuse, limit or cancel any Order for our products.

3. Returns and refunds policy
3.1 Due to the nature of the product, we do not accept returns or refunds for picnic boxes, platters, pop up picnics or events.
3.2 If you are unhappy with a homewares product purchased from our Online Store, email us at cleverlittlepicnic@gmail.com within 14 days of purchase, in which case we can provide you with a full refund on return of items (with costs of return to be met by you). Clever Little Picnic will not be liable and has no responsibility for any costs or expenses incurred in you undertaking such action.
3.3 If any product purchased from our Online Store is faulty, not of merchantable quality, not fit for its intended purpose or does not match the description (Defective Product) then please contact us by email at cleverlittlepicnic@gmail.com within 14 days of purchase with a photo of the relevant product. Once we have reviewed the photos and are satisfied that the product is a Defective Product, we can at our election provide you with a full refund or a replacement product (if available).
3.4 If we are unable to deliver you alcohol as part of your Order on account of you not being able to provide the necessary identification as set out in clause 6, we will provide you with a refund of the price of the alcohol forming part of the Order (determined at our discretion acting reasonably) within 14 days.

4. Picnics
4.1 What happens if there is poor weather?
We want you to enjoy your picnic and the weather can be unpredictable at times. If poor weather appears hazardous to your scheduled picnic (high winds, rain, storm etc.), email us at cleverlittlepicnic@gmail.com four hours prior to the scheduled for your picnic to discuss rescheduling to another day or time. There will be no rescheduling fee if we are informed 4 hours prior to your scheduled time.                                                                                                                    4.2 How to enjoy your Clever Little Picnic?
We recommend consuming your Clever Little Picnic within 2 to 4 hours after you have received it.
4.3 Where can we enjoy our Clever Little Picnic containing alcoholic beverages?
If your picnic contains alcohol, you will be able to enjoy it anywhere other than a designated area where the consumption and possession of alcohol in unsealed containers is prohibited under the Liquor Licensing Act 1997 (SA) (Dry Area).
For all picnic events located in Largs Bay, picnics containing alcohol must only be consumed at the Largs Bay Foreshore, as this area is not a Dry Area.

6. Alcohol
We encourage responsible service and consumption of alcohol with the sale of all alcohol on the Online Store in accordance with liquor licensing laws. Our current licence number is [57711092].
6.1 In purchasing any product containing alcoholic beverages in the Online Store, you warrant to Clever Little Picnic that:
(a) you are over the age of eighteen (18) years;
(b) any person that you are obtaining the products for, or supplying the products to, is also over the age of eighteen (18) years; and
(c) you will not supply or take any products to any liquor-restricted areas, alcohol protected areas, or Dry Areas.
6.2 We will request that the person who receives an Order containing alcoholic beverages at the delivery address (or who picks up an order) provide satisfactory evidence of proof of age to the person responsible for delivery of the Order. Clever Little Picnic will refuse to supply or deliver the Order containing alcoholic beverages if the person receiving the Order is unable or unwilling to provide evidence of proof of age. The Order will not be delivered to persons under the age of eighteen (18) years or to persons who fail to provide proof of age satisfactory to Clever Little Picnic that the person is eighteen (18) years or over.
6.3 It is an offence to sell, supply or obtain alcohol on behalf of a person under the age of 18 years.
